Can Trump legally impose an immigration ban to certain countries? Looks like he can.

The “immigration ban” calling for a number of countries to have certain restrictions on immigrating to the U.S. Has many people asking if the policy is actually legal.

    From what the constitution says, that is correct. Federal Law U.S.C 1182 (f) states;

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.” (breitbart.com)

The law gives the President the authority to follow through with his policy. Since he is using his executive powers, he bypasses Congress’s approval in implementing it.

Those oppose could address the fact that the President in his rethoric called for a ban on Muslims and question the legality of his plans. The United States cannot discriminate or prevent someone from legally immigrating solely on the basis of religion.

The administration and other supporters argue that it is a way to ensure national security and that the countries noted in the ban have a history of fostering, restraining  and even supporting terrorism.

    Keystone Pipeline back on

It what it seems to be a never ending deluge of executive orders, President Trump signs another authorizing the continuance of the construction of the controversial Keystone Pipeline.

The order gives the TransCanada the opportunity to re-submit for a permit in order to continue operations.

The move is seen by the administration as a way to boost exports and ease the reliance of imports from oil rich nations. Currently,  the U.S is the largest consumer of crude oil.

The move is also said to be a way to increase jobs and benefit the country’s overall energy infrastructure.

The order has been met by long standing opposition as the Standing Rock Tribe and environmentalist pledge to fight on. The Tribe and protesters won last year when President Obama halted the project.

Many opposed cite a danger to drinking water and the overall health of the environment and surrounding wild life. The project calls to tunnel under Lake Oahe which is adjacent to the Missouri River and the reservation.

What is the Mexico City Policy on Abortion?

Today President Trump signed an executive order reinstating the Mexico City policy or what is known as the “global gag order”. But what is it? And what does it mean?

The policy was first signed by President Reagan only to be rescinded by Democratic and reinstated by Republican administrations in a never ending back and forth. Now with a Republican presidential in the helm, it is once again implemented.

The policy restricts tax payer funds to fund non-governmental agencies  (NGO’s) from promoting and performing abortions in foreign countries as a part of family planning. That doesn’t include if an abortion is needed in life threatening situations, rape or incest cases.

The policy is a way to curb the support of coercive programs like The United Nations Population Fund who support China’s one child policy and forced abortions.

The policy itself does not diminish or restrict funding for contraceptives or other family planning services in order to avoid unwanted pregnancies that are not related to rape, incest, and life or death cases.

Pro-Choice supporters argue that the reinstatement of the policy will cause many women to seek unsafe means to terminate their pregnancies as well as limit access to clinics. While policy supporters state that tax payer funds shouldn’t be used for foreign abortions at their expense.

Trump’s mortgage increase could be a way to avoid potential bailouts.

Recently President Trump signed a bill that raised mortgage bills to non-wealthy first time home buyers in order to contribute to the Federal Housing Authority’s insurance program.

The FHA’s program is in the event of mortgage defaults by high risk borrowers. Many including new HUD Secretary Bill Carson feared that former President Obama’s rate reduction for first time buyers might leave The FHA without sufficient funds to handle another bailout of the banks like the one that crippled the economy about 9 years ago. The FHA required a bailout itself in the tune of over 1.7 billion dollars (Fortune).

Trump signs executive order to “ease” Obamacare.

In a hasty fashion, Trump signed his first executive orders on Inauguration day. The first order was to “ease” Obama regulations that place a “fiscal burden on companies, states, and individuals”.

The order was also set to be a pathway to improve flexibility in producing health care programs and encourage interstate commerce in health services and insurance.

Many have speculated it could be the first steps to repeal or replace Obamacare or even eliminate the individual mandate as well as reduce maternity or mental health coverages.

But so far the administration has remained vague on the order.

    Is Offshore Banking Illegal?

While I was reading in regards to U.S Treasury Secretary nominee Steven Munching being grilled about his involvement in business offshore accounts. I wanted to educate myself on its legality.

The media along with some government officials have portrayed it negatively over the years. What I found out was quite surprising.

I learned that it is legal to have an account in another country. In fact for as little as a couple of hundred dollars, foreign banks will let you open one. What makes it illegal is the failure to disclose your money to the IRS. Basically hiding it from them.

If you have money outside the U.S you must report it to the IRS or face fines, including jail time. This doesn’t come too much surprise because, well, it’s the IRS.

Now most of the stories I’ve heard have been about offshore accounts being tax havens. But there are good reasons why people have these accounts.

First and foremost having money offshore does not make it tax-exempt. Like I said earlier, the IRS wants you to report money earned and kept overseas. If you hide it, that’s when its illegal. The benefits are that many countries the money earned could be tax free. Not only that but offshore accounts allows you to invest internationally as well as earn more capital. There’s also currency exchanges and the investments you can make off that.

The U.S also accepts money from foreign entities and people too. Not so for the tax benefits but because it offers stability that other countries don’t have. There’s the fears of economic collapse, civil war or political upheaval that drive many to create accounts here.

So in short, offshore accounts are not illegal. They could a good way to invest and make more money as well to keep your money safe

    Obama Commutes Sentences¬†

President Obama today has commuted over 330 sentences for prisoners, bringing the total to over 1700 inmates. More than the last 13 President’s combined. Most of these sentences involved prisoners serving for drug offenses which the administration declares that it’s due to “outdated laws.”

They Clemency Project 2014 along with the Justice Department has been heavily involved helping inmates apply for Clemency since President Obama made it clear in 2014 that the Justice Department undertake efforts to maximize Clemency applications.
